E-delivery is a project of the Polish Ministry of Digital Affairs, which aims to facilitate communication between offices and citizens and enterprises. This project is expected to bring significant changes affecting the speed, convenience and security of sending official documents. As part of the Polish Act on Electronic Delivery, a new system for sending documents is introduced, which will replace the existing paper correspondence.
In accordance with the Polish Act of 18 November 2020 on electronic deliveries, the schedule for the implementation of e-deliveries assumed that the obligation to use e-deliveries would be imposed on the following entities from:
- January 1, 2025:
- persons performing professions of public trust (advocate, legal advisor, tax advisor, restructuring advisor, patent attorney, notary);
- non-public entities registering with the National Court Register (Pol. KRS) from 1 January 2025;
- non-public entities submitting an application for entry in the Central Registration and Information on Business;
- government administration bodies and budgetary units serving these bodies
- other public authorities, including state control and law enforcement bodies and budgetary units providing services to these bodies;
- the Social Insurance Institution and the funds managed by it, as well as the Agricultural Social Insurance Fund and funds managed by the President of the Agricultural Social Insurance Fund;
- National Health Fund;
- executive agencies, budgetary management institutions, state special-purpose funds, independent public health care institutions, public universities, the Polish Academy of Sciences and its organisational units, state and local government cultural institutions, other state or local government legal entities established on the basis of separate acts for the purpose of performing public tasks;
- local government units and their associations, as well as metropolitan associations and local government budgetary establishments – in the scope of the public service of registered electronic delivery;
- April 1, 2025 – entities entered into the National Court Register before 1 January 2025
- July 1, 2025 – non-public entities without an address for electronic delivery entered into the database of electronic addresses, entered into the Central Registration and Information on Business by 31 December 2024 – in the case of changes to the entry after 30 June 2025.
- October 1, 2026 – non-public entities registered in CEiDG by 31 December 2024
- October 1, 2029:
- Courts;
- Tribunals;
- Bailiffs;
- Prosecution
- law enforcement agencies
- Prison Service.
At the same time, we would like to draw your attention to the fact that a draft amendment to the Act on e-delivery is currently being processed in the Sejm. The draft assumes that e-deliveries will come into force on 1 January 2025, however, it is planned to implement a transitional period until 31 December 2025, under which the equivalence of delivery via the postal operator, ePUAP and other systems will be ensured with e-deliveries.
In addition, the draft provides for the extension of the obligation to have an e-delivery address to non-public universities and federations of entities of the higher education and science system. In addition, local government units and local government cultural institutions will be required to have an ADE and use the public registered electronic delivery service (PURDE) and the public hybrid service (PUH) within specified deadlines.
